Bangladesh’s 2025 Telecommunication Ordinance Amendment Threatens Human Rights

The Government of Bangladesh has introduced the Telecommunication (Amendment) Ordinance 2025, presenting it as a modernization of the country’s telecom framework. However, the amendment significantly expands state control over the digital ecosystem and raises serious concerns regarding freedom of expression, privacy, and other fundamental human rights.

 

The Ordinance goes beyond conventional telecommunications regulation by bringing a wide range of digital services under its scope, including social media platforms, over-the-top (OTT) services, content distribution networks, cloud services, data centres, e-commerce platforms, and emerging technologies such as artificial intelligence. This overly broad definition allows extensive government oversight of online communication and digital services.

 

The amendment also concentrates power within the executive branch by reducing the independence of the telecommunications regulator. Increased government control over appointments, removals, and decision-making processes weakens regulatory autonomy and limits transparency and accountability.

 

Furthermore, the Ordinance grants sweeping surveillance and interception powers, enabling authorities to monitor communications, collect user data, and access digital information without clear judicial oversight or procedural safeguards. Vague language and broad enforcement authority risk misuse and create a chilling effect on free speech.

 

Another critical concern is the law’s claim of supremacy over other existing legislation. This undermines legal consistency and weakens protections provided under data protection, media, and constitutional rights frameworks. The absence of strong privacy safeguards and independent oversight mechanisms places citizens’ digital rights at risk.

 

Overall, the Telecommunication (Amendment) Ordinance 2025 represents a significant threat to digital freedom in Bangladesh and highlights the urgent need for transparent law-making, public consultation, and alignment with international human rights standards.
