High Court Petition Challenges Validity of Bangladesh’s National Election and Referendum Schedule

On the same day, a writ petition was filed in the High Court challenging the validity of the schedule for the national parliament elections and the referendum. The writ petition seeks to suspend the notification of the schedule for holding the national parliament elections and the referendum on December 11. At the same time, the petition requests instructions to form a caretaker government and announce a new schedule for the elections.

 

On Monday (January 5), the writ was filed by Supreme Court lawyer Yunus Ali Akand. Later, he said that the writ petition could be heard this week by a High Court bench comprising Justice Ahmed Sohel and Justice Fatema Anwar.

 

The Chief Election Commissioner and other concerned officials have been made respondents in the writ.

 

Lawyer Yunus Ali Akand said that the Constitution does not mention anything about an interim government. Therefore, no election can be held under this government. Elections can only be held under a caretaker government or an elected government.
